NOTICE OF FORECLOSURE SALE Pursuant to the filed in the Third Circuit Court on November 28, 2022 in case number 3CC19100144K, the court appointed the undersigned Commissioner to sell the Property described below at a public auction and pursuant to the terms stated: The Property: 64-411 Bucky Hill Lane, Kamuela, Hawaii 96743. Tax Map Key (3) 6-9-017-047. Open House: January 18 and 25, 2025, 2:00 p.m. to 4:00 p.m. Individuals wishing to appear at the open house event(s) should contact the Commissioner in advance. Public Auction: The public auction will be held on February 7, 2025 at 12:00 noon at the Keahoulu Courthouse located at 74-5451 Kamakaeha Avenue, Kialua-Kona, Hawaii 96740 at the flagpole. Terms of Sale: There is no upset price. The Property will be sold in its “as is” condition with no warranties of title or possession. The successful bidder must pay a down payment of not less than ten percent (10%) of the highest successful bid price and deposit the same with the Commissioner at the close of the public auction, payment to made in cash, money order, cashier’s check or certified check. Bidders must provide proof of their ability to comply with the 10% down payment requirement or the bidder’s ability to make a credit bid prior to the start of the public auction. The sale shall not be final until the court has approved and confirmed the sale at a subsequent hearing therefor. At the confirmation hearing, the court may allow further bidding provided that the initial opening bid at the hearing must be at least one-hundred and ten percent (110%) of the highest bid received at the public auction and must be made in person at the hearing. The court-approved purchaser must pay the confirmed sale price on or before the date established by the court together with all costs and expenses for securing possession of the Property and for completing the sale, including preparation of conveyancing instruments, conveyance taxes and recordation fees. The sale shall not be made subject to conditions pertaining to the use of an escrow agent, the securing possession or the availability of title insurance. Real estate brokerage commissions will not be paid from the sale proceeds. The ten percent (10%) down payment may be forfeited in full or in part if the successful bidder fails to pay the balance of the purchase price. NOTICE OF FORECLOSURE SALE Pursuant to Findings of Fact, Conclusions of Law and Order Granting Plaintiff’s Motion for Summary Judgment Against all Defendants and for Interlocutory Decree of Foreclosure, filed October 1, 2024, in Lakeview Loan Servicing, LLC vs. Lore-Lin Kaleolani Makaiwi, et al., Civ. No. 3CCV-23-0000421, Circuit Court of the Third Circuit, State of Hawaii, the undersigned Commissioner will sell the following described property at public foreclosure sale on the date and at the time set forth below. PROPERTY DESCRIPTION: Real Property situate at Keaau, District of Puna, Island and County of Hawaii, State of Hawaii, being Lot 86, area 12,000 square feet, more or less, of Block 15, as shown on Map 70, filed in the Office of the Assistant Registrar of the Land Court of the State of Hawaii with Land Court Application No. 1053 (amended) of W.
